A driver's License suspension may no longer be mandatory in many drug cases in Ohio. Senate Bill 204 and a companion bill currently under consideration in the House would eliminate the imposition of mandatory driver's license suspensions in the majority of criminal drug offenses in Ohio. Currently, Ohio is one of sixteen states that requires a driver's license suspension be imposed by a sentencing court even in minor misdemeanor marijuana possession cases. The minimum suspension in such matters is six months. The new proposals would instead give judges discretionary powers to impose suspensions unless a motor vehicle was used while committing the drug offense or in OVI matters where such suspensions would continue to be mandatory. This proposal would bring Ohio in line with the surrounding states of Kentucky, Michigan, and West Virginia which do not mandate the imposition of drug-offense suspensions.

The Ohio Supreme Court struck down Ohio's Child-Enticement Statute, ruling that it is unconstitutionally overbroad. In State v. Romage Slip Opinion No. 2014-Ohio-783, the court struck down Ohio Revised Code section 2905.05(A), finding that it sweeps within its prohibitions a significant amount of constitutionally protected activity.
The statute provides: No person, by any means and without privilege to do so, shall knowingly solicit, coax, entice, or lure any child under fourteen years of age to accompany the person in any manner, including entering into any vehicle or onto any vessel, whehter or not the offender knows the age of the child, if both of the following apply:
(1) The actor does not have express or implied permission of the parent, guardian, or other legal custodian of the child in undertaking the activity.
(2) The actor is not a law enforcement officer, medic, firefighter, or other person who regularly provides emergency services, and is not an employee or agent of, or a volunteer acting under the direction of, any board of education, or the actor is any of such persons, but, at the time the actor undertakes the activity, the actor is not acting within the scope of the actor's lawful duties in that capacity.
The court reasoned that the statute could be construed to criminalize the following scenarios, and was therefore overbroad: "a primary-school coach offering to drive a team member home to retrieve a forgotten piece of practice equipment; a parent at a community facility offering to drive another's child home so she does not have to walk; a senior citizen offering a 13-year-old neighborhood child money to help with household chores; a 14-year-old asking his 12-year-old friend to go for a bike ride."

The grace period for Ohio's texting-while-driving ban is at an end. Law enforcement may now issue citations instead of mere warnings for violations of the law.
The ban is one of the country's most restrictive for minors, making it illegal for those under eighteen years of age to use any hand-held electronic device while driving. The ban applies even when drivers are stuck in traffic or stopped at a red light. Exceptions to the ban are made for pre-programmed voice-operated or hands-free GPS devices, using the devices outside a lane of travel, and for bona fide calls to emergency personnel.
For minors, that means no calling, no texting, no looking up directions on a GPS device, no e-mails, no videogames, no surfing the web, no use of laptops and tablets, and no changing songs on an ipod.
The law classifies a violation as a primary offense, meaning that law enforcement personnel can pull over minors who are suspected of being in violation of the law. Penalties for a first offense include a fine of $150 and a license suspension of 60 days. A second offense may bring a $300 fine and a license suspension of one year.
For adults, the state law prohibits drivers from wrinting, sending or reading text messages. Adults may still talk on their phones. An offense is a minor misdemeanor with the possibility of up to a $150 fine.

Speed Cameras have been installed in the communities of New Miami in Butler County (U.S. 127 and 7 Mile) and Elmwood Place in Hamilton County (Township Ave., Vine Street, and Prosser Ave.). Tickets are being issued to the registered owner of a vehicle that is photographed allegedly in violation. The Ohio Department of Agriculture has announced the expansion of the Asian Longhorned Beetle Quarantine Zone to 61 square miles in Clermont County, Ohio. The movement of hardwood logs, firewood, stumps, roots, and branches is now prohibited in the quarantine zone in an effort to prevent the spread of the non-native wood boring species. A map of the additional 268 parcels of property in Batavia and Stonelick Township as well as a description of the beetle can be found at the following link: www.agri.ohio.gov

Black Boxes, the data recording devices used in commercial aviation, may be coming to new vehicles soon.
The National Highway Traffic Safety Administration announced today that new federal standards for automobile data recorders will take effect as planned this year.
For now, the standards for the devices that record information preceding auto collisions or other events only apply to vehicles that have been voluntarily equipped. Such information may be useful in determining fault in contested accidents. It may also provide insurers with information relative to underwriting.
The NHTSA has publicly considered requiring all vehicles to have black boxes installed. However, Congress has not yet taken action to approve such a plan amid opposition from privacy groups and auto manufacturers.

No more checking Facebook statuses while driving for young drivers….
The Ohio House of Representatives is considering banning texting while driving for all drivers, and prohibiting sixteen and seventeen-year-olds from using any hand-held devices while behind the wheel.
The Ohio Senate passed the bill last week, and it is now under consideration by the House. Ultimately, the ban must be signed into law by Governor John Kasich.
Under the proposal, texting would be prohibited for all drivers. The law would go even further for drivers under eighteen, prohibiting all use of cellphones and other electronic devices for typing and talking.
Adults violating the law would face a minor misdemeanor charge and a maximum fine of $150. Juveniles would face a $150 fine and a sixty day operator’s license suspension, with subsequent violations resulting in higher penalties.
